Terms of service

Dieses Dokument gibt es auf Englisch (verbindlich) und Niederländisch. English · Nederlands

These terms apply to every order with heresmine and to the use of your card and dashboard. We've kept them as short and clear as we can. This English text is the binding version; the Dutch translation is there for convenience.

1. Who we are

heresmine is a service by MP Agency, a company registered in Dubai, United Arab Emirates. Full company details, such as the trade licence and address, are in the imprint. In these terms we call that ‘we’. You are the customer who orders a card or subscription.

Questions about these terms? Email info@heresmine.app. We usually reply within one working day.

2. Business or consumer

heresmine is made for people who use it for their work: business owners, freelancers and organisations. You must be 18 or older. If you order on behalf of a company or organisation, you confirm that you're allowed to.

If you still order as a consumer, so not for a business or profession, you also have the rights that the law of your country gives you, such as the right of withdrawal in section 10. Those rights always come before these terms. A clause that would take away something the law gives a consumer doesn't apply to that consumer.

3. Ordering

You order on the website. Before you pay, you see a summary of your plan and the options you chose, what you pay today, and what you pay per month or year after that and from which day, and you agree to these terms. The contract is complete once checkout succeeds: when your payment goes through or, with a free trial and nothing to pay today, when your payment details are accepted. You then get a confirmation by email with the version of these terms and a link to your dashboard. Keep that email.

Any delivery time we mention is a target. If we miss it, we'll tell you and agree a new date.

4. What you get

You get the plan as shown on the pricing page when you ordered, with the options you chose. Every plan has a digital card in your brand, set up from your website and checked by a person, with QR code, Wallet pass and lock-screen wallpaper. Pro and Teams add monthly benefits, such as event mode and your own line with us on WhatsApp, and start with 14 days free (section 20); the pricing page lists the benefits in full. Besides the plans there's the free card from the app (section 19).

Options are one-off and only what you choose: a designer's finish (Basic and Pro), the team design with kick-off and, on top of it, express (Teams), NFC cards with shipping, extra languages and your own domain.

With a designer's finish, a designer finishes your card once: cropping and lighting your photo, fine-tuning colours and type, a sharp logo and the layout. It's ready within one working day of your order and has no correction round. With Pro you ask for small changes through your line on WhatsApp.

The team design (Teams) starts with a kick-off with you. After that a designer makes one design for the whole team within three working days, or within one working day if you added express.

Your card lives on our domain, or on your own domain if you have that option.

5. Prices, tax and payment

Prices are shown in the currency you choose when ordering. The pricing page shows which currencies we offer. We charge in that currency; your bank may add a fee if it isn't the currency of your account.

Our prices exclude VAT and similar taxes. At checkout, before you pay, you see the total with the tax that applies to you. That depends on your country and whether you order as a business: customers in the UAE pay 5% VAT once MP Agency is VAT-registered (our tax registration number is then in the imprint); consumers in the EU and the UK pay the VAT of their own country once we're registered there; businesses in the EU with a valid VAT number get VAT reverse-charged; elsewhere local tax may apply. So enter your VAT number if you have one.

Setting up and checking your card is included in every plan; there's no setup fee. On the day you order, you pay the options you chose and your first month or year. With a free trial of Pro or Teams (section 20) you pay only the options that day, and your first month or year when the trial ends. After that you pay in advance per month or per year. Payment runs through Stripe; we never see your card number. Your invoices are in your dashboard.

If our prices change, we'll tell you by email at least thirty days in advance. The new price applies from your next renewal after those thirty days. You can cancel until then.

6. Teams: price per person

Teams is priced per person and is for five to 99 people. You pay for the number of places you order, even if not all of them are in use yet. From 100 people we make you a proposal, with payment by invoice.

Need more places? Get in touch and we'll add them. Each extra place costs the price per person from then on.

7. Changing plan

You can switch between Basic and Pro at any time in your dashboard. The switch takes effect straight away: your subscription runs at the new plan's price from that moment, and the difference for the current period goes on your next invoice. If you switch to Basic during the free trial of Pro, Basic starts when the trial ends (section 20).

Options such as a designer's finish or an NFC card aren't part of a switch; you order them separately. If you go back from Pro to Basic, the monthly benefits of Pro stop; your card's design and the event labels on your contacts stay. Moving to or from Teams is something we set up with you.

8. When a payment fails

If a payment fails, Stripe retries it a few times and emails you about it. If it stays unpaid, or your subscription ends, we pause your card. Its page then only shows your name, so your link, QR code and NFC card no longer show your details.

Once the payment comes through, your card comes back on its own, exactly as it was.

9. Automatic renewal and cancelling

Your subscription renews automatically, per month or per year, until you cancel; a free trial turns into a paid subscription the same way (section 20). This is also stated next to the payment button and in your confirmation.

You can cancel any time in your dashboard, under Subscription. The subscription then ends at the end of the current period: the end of the month for monthly billing, the end of the year for yearly billing. During a free trial, the current period is the trial (section 20). Until then your card keeps working. Outside the right of withdrawal we don't refund part of a period.

Options we've already carried out are non-refundable, such as a designer's finish or NFC cards already in production, except where the right of withdrawal in section 10 applies.

We can end your subscription with thirty days' notice, or straight away if you break section 12 or 13. If we end it without you doing anything wrong, we refund the part of the period you haven't used.

10. Right of withdrawal for consumers in the EU and UK

Do you live in the EU or the UK and order as a consumer, so not for your business? Then you can withdraw from your order within 14 days, without giving a reason. Those 14 days start on the day the contract is complete (section 3).

To withdraw, use the ‘Withdraw from contract’ button in your dashboard under Subscription (it's there while the 14 days run; you get an acknowledgement by email straight away), or email us at info@heresmine.app within those 14 days. Just tell us you want to withdraw. You can use the model text below, but you don't have to.

Model withdrawal textTo MP Agency, address to follow after registration, info@heresmine.app:I hereby give notice that I withdraw from my contract for the following service: heresmine, plan [plan].Ordered on: [date]Name: [your name]Address: [your address]Date: [today's date]

We refund you within 14 days of receiving your withdrawal, using the same payment method. Because you asked us at checkout to start straight away, we deduct a proportional amount for the work already done when you withdrew: the days your card was live and the design work already finished.

If your plan starts with a free trial (section 20), the 14 days also start on the day you order, not when the trial ends. If you withdraw during the trial, you pay nothing for the plan. When the trial turns into a paid subscription, you don't get a new withdrawal period: the price and the day of the first payment were clear to you before you ordered. Where the law of your country does give you one, you keep it.

Personalised NFC cards are made to your specifications, with your name and design. The right of withdrawal doesn't apply to them, so they can't be returned. If a card arrives damaged or doesn't work, section 11 applies.

If you live elsewhere, section 9 applies. If the law of your country gives you a cooling-off period as a consumer, you keep it.

11. NFC cards and shipping

NFC cards are an option on every plan. With Basic and Pro we make your card straight after your order and our check or, with a designer's finish, once you've approved the design. With Teams we make the cards once your team is in, because the names are on them, and with the team design only after you've approved the design. We send them to the address you give us at checkout.

Shipping isn't included in the price of a card. You pay it per shipment, by zone: the United Arab Emirates, the European Union or the rest of the world, as shown before you pay. Cards for the EU come from a printer in Europe, all others from Dubai. Every shipment has tracking. We ship to the countries you can choose when ordering, and only to an address in the country you chose. Import duties or taxes on arrival, if your country charges them, are yours.

If a card arrives damaged or doesn't work, tell us within fourteen days of receiving it and you'll get a new one. Any legal guarantee rights you have as a consumer apply on top of that.

If you lose a card, you can order a new one with the same link on every plan, at the price on the pricing page plus shipping. The old one keeps working too: it only opens your public card page.

12. Your content and our rights

You're responsible for what's on your card. Make sure you have the right to use your logo, photos and texts and that they're accurate. Your content stays yours.

You allow us to store, show, resize and process that content as far as needed to make your card work, and to make a share image and Wallet pass from it. We may remove content that is unlawful or misleads others.

The software, the card designs, the templates and the heresmine brand stay ours. While your subscription runs, you may use your card and the designs we made for you for your own work. You may not copy, rebuild or resell our software. An NFC card we send you is yours.

13. Fair use

Don't use heresmine to pose as someone else, to send spam, to publish content that is unlawful, abusive or misleading, or to overload or bypass our systems. If you do, we may take your card offline and end your subscription.

Report a card that impersonates you to info@heresmine.app; we review it within 2 working days and may take it offline.

14. Availability

We do our best to keep your card online at all times but can't promise nothing ever goes wrong. We schedule maintenance outside office hours where we can and tell you in advance if it takes longer.

15. Liability

If something goes wrong that we're responsible for, our liability is limited to what you paid us in the twelve months before. We're not liable for indirect loss, such as lost revenue, lost contacts you could have downloaded yourself, or damage to your reputation.

This limit doesn't apply to our intent, fraud or gross negligence, to death or injury caused by us, or where the law doesn't allow a limit. If you're a consumer, you keep every right the law of your country gives you.

You hold us harmless against claims by others about the content of your card, for example a logo or photo you had no rights to.

16. After it ends

When your subscription ends, we pause your card as described in section 8. Six months after that pause we delete the card with its contacts and statistics. If you want to keep your contacts, download them as CSV in your dashboard before then.

You can also delete your account yourself in Dashboard → Settings. That deletes your account, cards, contacts, statistics and photos straight away. We keep orders and invoices for as long as tax law requires, at least five years.

17. Privacy

How we handle personal data is in our privacy policy. For the contacts that come in through your card and for your card's statistics, you are the controller and we are the processor. Our data processing agreement, which comes with your subscription or free card, covers that.

18. Changes

We may change these terms, for example when the service or the law changes. Changes that matter to you are announced by email at least thirty days in advance. They apply from your next renewal after those thirty days. If you don't want them, you can cancel until then.

The version and date of these terms are at the top. The version you accepted is in your confirmation email.

19. The free card

In the heresmine app you can make a free digital card: one card in one language, with ‘Made with heresmine’ under it. Sharing, QR code, Wallet pass, widget, contacts and voice notes work as with Basic. NFC cards, event mode, the scanner, teams and the connection to your CRM aren't included. The pricing page shows what each plan has.

The free card isn't a trial (Pro and Teams have one, section 20). It has no end date, we don't charge for it and it never turns into a subscription by itself. If you want more, you order a plan yourself on the website. That plan then goes on the same card, with the same link. If that plan stops later, or a payment stays out, we don't pause your card as in sections 8 and 16: it becomes a free card again, live on the same link.

These terms apply to the free card, except what's about paying, cancelling, withdrawal and the trial (sections 5 to 11 and 20). You can always delete your free card and your account yourself (section 16). We may take a free card offline if you break section 12 or 13.

If we ever stop offering free cards altogether, we'll tell you by email at least thirty days in advance, so you have time to download your contacts or choose a plan.

20. Free trial of Pro and Teams

Pro and Teams start with a free trial of 14 days, with everything in the plan. Basic has no trial. A trial is once per customer: if you've paid for an order with us before or had a subscription, your plan is paid from the first day. You see that at checkout, before you pay.

You enter your payment details when you order. We charge nothing for the plan during the trial. Options are charged when you order, as section 5 says: NFC cards with shipping, a designer's finish, the team design with express, extra languages and your own domain.

At the end of the trial your plan turns into a paid subscription automatically, at the price you saw when you ordered, per month or per year, and on Teams per person for your places. From then on section 9 applies. Three days before the trial ends, we email you the day and the amount of the first payment. If that payment fails, section 8 applies.

Until the trial ends you can cancel in your dashboard, under Subscription; you then pay nothing for the plan. On Pro you can also switch to Basic. That starts when the trial ends, at Basic's price, and until then you keep everything in Pro.

If you cancel during the trial, your card keeps working until the trial ends and is then paused, as in sections 8 and 16. A card that started as a free card in the app becomes a free card again (section 19). Options you've already received, or that we've already carried out, aren't refunded when you cancel, except under the right of withdrawal (section 10).

21. Inviting friends

As a customer you have your own invite link, in your dashboard under Subscription → Invite friends. You share it yourself, with people who'll find it useful. Don't put it on coupon sites or in paid ads, and don't send it in unsolicited messages.

Your friend gets 10% off every invoice in their first twelve months: the first order, including one-off items and shipping, and the monthly or yearly amounts that fall within those twelve months. To get it, your friend orders in the same browser within sixty days of opening your link, with an email address that has never paid us before. The discount comes off automatically at checkout and can't be combined with another discount code.

You get a month free once your friend's first payment succeeds: credit worth one month of your own subscription (on a yearly plan, a twelfth of the yearly amount), but never more than your friend paid in that first payment. If your friend paid in another currency, the credit is the monthly price of one seat on your own plan. The credit comes off your next invoices. If you don't have a paid plan yet, for example only the free card, it waits until your first invoice. There's no limit on the number of friends.

Credit isn't money. We don't pay it out, you can't transfer it, and it lapses if you delete your account.

Inviting yourself doesn't count, not even under another email address. If your friend's payment is refunded, withdrawn or disputed, we take the credit back; if you'd already used it, the amount goes on your next invoice. In case of abuse we may refuse or take back credit.

Your friend sees your first name when ordering. You only see how many friends ordered, not who. Our privacy policy has more on this.

We may change or end the programme. That then applies to new invites: discounts and credit already earned stay.

22. Law, courts and complaints

These terms are governed by the laws of the United Arab Emirates as they apply in the Emirate of Dubai. Disputes we can't settle together go to the courts of Dubai. We never oblige you to arbitrate.

If you're a consumer in the EU, the UK or another country, you keep the protection of the mandatory rules of your own country and you may also go to court there.

If you have a complaint, email info@heresmine.app first. You usually get an answer within one working day, and we'd rather find a solution than a judge. If we can't work it out, you can turn to the consumer protection department of the Ministry of Economy or of the Dubai Department of Economy and Tourism in the UAE, to the consumer authority or dispute resolution body of your country in the EU, and to Citizens Advice or Trading Standards in the UK.
